Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) form a binding agreement between you and LifeMantle (“LifeMantle,” “we,” “us”). By creating an account, accepting an invitation, or otherwise using the LifeMantle website, applications, and services (the “Service”), you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility & children's information

You must be at least 18 years old to create a space. Because LifeMantle is designed for families to keep memories of children, you represent that you are the parent or legal guardian of any child whose photos or information you add, or that you have that person's permission. You are responsible for the content anyone you invite contributes to your space.

3. Your account

Keep your login credentials confidential and enable available security features (such as two-factor authentication). You are responsible for activity under your account. Tell us promptly at privacy@lifemantle.com if you suspect unauthorized use.

4. Your content & the license you grant us

You keep ownership of the photos, text, and other content you add (“Your Content”). You grant LifeMantle only the limited, non-exclusive license needed to host, back up, process, and display Your Content to you and the family members you invite, and to operate and improve the Service. We do not sell Your Content, and we do not use it to train machine-learning models. This license ends when you delete the content or your account, except for copies retained transiently in routine backups.

5. Acceptable use

You agree not to:

• upload unlawful, infringing, or harmful content, or content you don't have the right to share;
• invite people you do not trust, or use the Service to harass or harm anyone;
• attempt to breach, probe, or circumvent security, access controls, or rate limits;
• interfere with or place undue load on the Service or its infrastructure.

6. Intellectual property & prohibited copying

The Service itself — including its software, source and object code, design, “look and feel,” layout, user interface, graphics, logos, name, and all related content we create (collectively, the “LifeMantle Materials”) — is owned by LifeMantle and protected by copyright, trademark, trade-dress, and other laws. Aside from Your Content, nothing in these Terms transfers any right, title, or interest in the LifeMantle Materials to you.

You are strictly prohibited from:

• scraping, crawling, harvesting, or using bots or automated means to access, read, or extract any part of the Service or its content;
• copying, cloning, mirroring, or replicating the Service, or reproducing its design, layout, user interface, or “look and feel,” in whole or in part, to build or operate a similar or competing product;
• reverse engineering, decompiling, or disassembling the Service, or attempting to derive its source code or underlying structure;
• framing, mirroring, deep-linking, or embedding the Service without our written permission;
• using any LifeMantle Materials or content accessed through the Service to train, fine-tune, or develop any machine-learning or AI model or dataset; or
• removing, obscuring, or altering any copyright, trademark, or other proprietary notices.

These restrictions are a material part of this agreement. We may pursue all available legal and equitable remedies — including injunctive relief — for any violation.

7. Data, backups & durability

We work hard to keep your memories safe, and we provide a self-serve export so you always have your own copy. Even so, no online service can guarantee that data will never be lost. Please keep your own copies of anything irreplaceable. See our Security page for how we protect your data.

8. Subscriptions & billing

Paid plans, when available, are billed through our payment processor and renew automatically until cancelled. You can cancel anytime; access continues through the end of the paid period. Fees are non-refundable except where required by law.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, LifeMantle will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold LifeMantle harmless from claims arising out of content you contribute or your breach of these Terms.

12. Termination

You can delete your account at any time. We may suspend or terminate access if you materially breach these Terms (including the copying restrictions in Section 6).

13. Changes to these terms

We may update these Terms from time to time; we'll revise the “last updated” date above, and material changes will be communicated where appropriate. Continued use after changes means you accept them.

14. Governing law & contact

These Terms are governed by the laws of the United States and the state in which LifeMantle operates, without regard to conflict-of-laws rules. Questions? Email customerservice@lifemantle.com.
